Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

 

Definitions

For the purposes of these Terms and Conditions:

Account means a unique account created for You to access our Service.
Country refers to: Switzerland
Association (referred to as either "the Association", "We", "Us" or "Our" in this Agreement) refers to ecorisQ, P.O. Box 2348, 1211 Geneva 2.
Content refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.
Attendee means any person who has paid a registration fee to attend a conference or other event organized by the Association.
Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
Members are (non-)professionals who have a Subscription to Our Service in order to use Our Tools.
Multiple registration is more than one registration in a transaction (either more than one person, or more than one conference).
Service refers to the Website.
Subscriptions refer to the services or access to the Service offered on a subscription basis by the Association to You.
Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Association regarding the use of the Service.
Tools refer to the different Tools (software) The Association is offering on the Website.
Website refers to ecorisQ, accessible from https://www.ecorisq.org/ or
https://www.ecorisqevents.com/


You means the individual accessing or using the Service, or the Association.

 

Acknowledgment

This document sets out the terms and conditions between the Association and You when You register for any subscription, event or conference organized by the Association. By registering for a subscription, event or conference organized by the Association You are agreeing to comply with these terms and conditions. You should read this document carefully.

Submission of a registration is regarded as affirmation of your acceptance of the Terms & Conditions. Should you not wish to accept the Terms & Conditions you should not register.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Association. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

 

Conferences and Events

Your Information

If You wish to register for a conference or event available on the Website, You may be asked to supply certain information relevant to Your registration including Your name, Your email, Your phone number.

 

Registration

Registration to a conference or event entitles an Attendee to attend all (academic) sessions organised by the Association. There may be a fee charged for some (academic) sessions based on entry fees charged by external third parties.
Multiple registration and its associated rates is based on more than one registration in a transaction (either more than one person, more than one conference).

 

Payments

All Subscriptions and tickets purchased are subject to a one-time payment. Payment can be made through payment methods we have available, such as online payment methods (PayPal) and bank transfer.

 

Refund

No refunds will be given on registration fees. Registration can be transferred to another Attendee, under certain conditions. You have to contact the Association if wishing to do so.

 

Conference Accommodation (if applicable)

If applicable, accommodation rates for the conference hotel are valid within seven calendar days of the date quoted. Accommodation availability and rates are subject to change according to supply and international exchange rate fluctuations.

An accommodation booking at the conference hotel is not confirmed until payment has been made in full. Conference accommodation payment and refund policies are bound by the contract conditions imposed on the Association by the hotel or supplier.

Accommodation bookings are non-refundable. The Association will actively assist with achieving a refund but availability of such refunds is at the discretion of the hotel.

 

Service as an invited speaker

If you agree to speak at an event or conference by the Association, we may share your contact and biographical information with event attendees. Sometimes we may also request a photograph. In other cases, we post on the respective event website information such as your name, employer, physical work address, work email address, as well as a link to your company website and/or professional LinkedIn page available to the public. This is so that visitors to the event website, including event attendees and speakers, can contact you with questions and requests for more information, and to provide feedback if needed. Additionally, speakers may be asked to complete a release agreement or copyright form prior to their presentation.

 

Usage of photographic and video material taken at Our events

To comply with global data privacy laws, the Association imposes certain restrictions on the use of multimedia at its events (e.g. photography, video, audio, online streaming, and all future mediums). An Attendee is permitted to use hand-held cameras and/or smart phones to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever.

The Association may hire professional service providers (photo/video/streaming/audio) to document and display the event experience. Attendees and sponsors are encouraged to capture their event experiences and post their own social content from the event (text, photos, audio, video, streaming), provided it does not infringe upon the rights of any attendee, sponsor, third party, or the Association. Such infringement would include, but is not limited to, defamation or infringement of intellectual property rights. In the event an attendee requires a release or permission to protect the rights of a third party, obtaining such a release or permission shall be the sole responsibility of the attendee.

By attending the event, You acknowledge and agree as follows: (a) the Association may edit and use footage it captures at the event for marketing and promotional activities and for any other lawful purpose in the ordinary course of its business; and (b) due to the prevalence of mobile recording devices in today’s world, the Association disclaims all liability for the capture of your image in any multimedia format by other Attendees at the event.

 

Liability waiver & release

In consideration of being allowed to register for, and participate in the event, you hereby warrant and represent that you are age 18 or above and freely waive, release from liability, assume all risks, and covenant not to sue the Association or its members, employees, board members, or volunteers for any expense, loss, damage, personal injury, including loss of life, illness, including but not limited to COVID-19, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the event, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of the Association.
This Liability Waiver and Release is specifically binding upon your heirs and assigns and is knowingly given.

 

Subscriptions

Subscription period

The Service or some parts of the Service are available only with a paid Subscription. You will be billed in advance on a recurring and periodic basis (annually). After Subscription, You become a Member in Our network.

At the end of each period, Your Subscription will automatically renew under the exact same conditions unless You cancel it or the Association cancels it.

 

Subscription cancellations

You may cancel Your Subscription renewal either through Your Account settings page or by contacting the Association. You will not receive a refund for the fees You already paid for Your current Subscription period and You will be able to access the Service until the end of Your current Subscription period.

 

Payments

The Association will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
In case payment by bank transfer is not possible for You, You can request to make the payment using the online payment method PayPal.

 

Fee Changes

The Association, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period.

The Association will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to terminate Your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes Your agreement to pay the modified Subscription fee amount.

 

Refunds

Except when required by law, paid Subscription fees are non-refundable.

Certain refund requests for Subscriptions may be considered by the Association on a case-by-case basis and granted at the sole discretion of the Association.

 

User Accounts

When You create an account with Us, You must provide Us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.
You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

 

Content

Your Right to Post Content

Our Service allows You to post Content. You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, You grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of Your rights to any Content You submit, post or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the Service, who may also use Your Content subject to these Terms.

You represent and warrant that: (i) the Content is Yours (You own it) or You have the right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

 

Content Restrictions

The Association is not responsible for the Content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable.

The Association reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with this Terms, refuse or remove this Content. The Association further reserves the right to make formatting and edits and change the manner any Content. The Association can also limit or revoke the use of the Service if You post such objectionable Content. As the Association cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk.

 

Content Backups

Although regular backups of Content are performed, the Association do not guarantee there will be no loss or corruption of data.

The Association will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that the Association has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.

 

Intellectual Property

The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Association and its licensors.
The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Association.

 

Your Feedback to Us

You assign all rights, title and interest in any Feedback You provide the Association. If for any reason such assignment is ineffective, You agree to grant the Association a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

 

Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.

 

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Association, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, and warranties that may arise out of course of dealing, course of performance, or usage. Without limitation to the foregoing, the Association provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, the Association does not make any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, the content, or e-mails sent from or on behalf of the Association are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

 

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

 

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Association.

 

Changes to These Terms and Conditions

We reserve the right, to change, amend, add or remove any of the above Terms & Conditions in its sole discretion and without prior notice. If one or more of the conditions outlined in these Terms & Conditions should become invalid, the remaining conditions will continue to be valid and apply. These Terms & Conditions apply to all event participants (attendees, speakers, sponsors, exhibitors) and Members.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Website and the Service.
